These terms apply when you buy a report, or a Pro or Analyst subscription, from HostingBrain. They sit beside the Terms of Service, which cover the connector and the website.
Reports are sold through Polar (Polar Software, Inc.), which acts as the merchant of record: Polar is the seller at checkout, takes the payment, issues the receipt and handles VAT. Polar's own buyer terms apply to the payment. The report and the licence to use it come from HostingBrain ApS, CVR 46679091, VAT DK46679091, Store Kannikestræde 10, 1169 København K, Denmark.
Reports are business research, written for companies, investors and their advisers, and anyone may buy one: a company, a sole trader or an individual. If you buy for a VAT-registered business, choose to buy as a business at checkout and give its VAT ID; otherwise Polar charges the VAT due where you are (section 4). If you buy as a consumer, the consumer law of your country applies alongside these terms, and nothing here limits the rights it gives you. Our refund policy says when we refund.
A file generated for your order from the current release of our data on the day you buy. After payment you are taken to your order page, where the file appears within minutes. The download link works for 30 days and a limited number of downloads. If you lose it within those 30 days, write to us with your order number and we re-issue the same file. After 30 days the file is deleted, so a re-issue is a newly generated file from our then-current data release, which we can make while we still hold the order (24 months).
The file names you, or the organisation you bought for, as the licensee. Its use is governed by the data licence.
Pro and Analyst are monthly subscriptions to the connector at the plan's published price. When you subscribe, Polar issues your API key; you find it in Polar's customer portal. The subscription renews each month until you cancel it in that portal. It then runs to the end of the month you have paid for, and the key stops working when the subscription ends. Your use of the connector is governed by the Terms of Service.
The total, including any VAT, is shown at checkout before you pay. Polar charges VAT where it applies, and applies the reverse charge when you give the VAT ID of a business registered for VAT in the EU.
A report is market research on hosting and domain infrastructure. Its figures are analytical estimates with stated denominators and caveats - floors, ceilings or estimates as labelled - not audited facts. It is not investment, financial, legal or tax advice, and it recommends no course of action.
To the extent the law allows, our total liability for a report is the price paid for it, and we are not liable for indirect or consequential loss or for decisions taken on the basis of a report.
Danish law applies and the courts of Copenhagen have jurisdiction. If you buy as a consumer, you keep the protection of the mandatory law of the country where you live, and you may bring a claim in the courts there.
